Position Summary:

As in-house Privacy Counsel, you will oversee HARMAN’s compliance with data privacy laws. Responsibilities will include assisting HARMAN with monitoring compliance with data privacy rules, regulations and standards, and attending to various legal compliance matters, privacy training, developing and enforcing established policies, and identifying the need for new guidance/training.  You will also assist with implementation of a global corporate data privacy program.

 

Job Responsibilities:

  • Serve as legal counsel on data protection and privacy matters.
  • Advise the business on legal compliance requirements applicable to the privacy and management of the personal information of customers, employees and other individuals with whom the company interacts and related confidential personal information.
  • Provide guidance, support and leadership on privacy and data protection legislation and regulation in Europe, particularly the GDPR.
  • Conduct risk assessments and provide data protection advice on third party data processors and vendor transactions implicating data privacy laws.
  • Conduct data privacy risk assessments of HARMAN products and service offerings.
  • Assess the impact of new and existing regulations or laws on existing operations and offerings; provide advice to the IT, Product and other relevant business teams to foster privacy by design and alignment with applicable legal requirements and corporate data protection policies and standards.
  • Advise on the requirements and restrictions for international transfer of personal data by HARMAN and its contracting parties in the context of European data processing and information transfers, including the use of mechanisms such as SCC, BCRs and Privacy Shield.
  • Provide guidance and advice on appropriate data protection terms for vendor, supplier, customer and employee agreements, as well as RFP’s, bids, and strategic business partnerships. Collaborate with, and support other lawyers with respect to legal forms, agreements, policies and notices in order to protect HARMAN’s commercial and legal position in relation to data privacy requirements.
  • Support critical incident management processes in addressing suspected or actual data privacy and security incidents. Assess whether such privacy and security incidents potentially involve personal or sensitive data, provide counsel on the appropriate containment, investigation and remediation of any breaches; and advise on notification and regulatory reporting requirements, as well as relevant communications, working in collaboration with IT, Corporate Communications and relevant business teams.
  • Provide advice concerning requests for access to personal information.
  • Remain current on legal, regulatory, industry, political and macroeconomic developments affecting data protection and privacy.
  • Support the maintenance of a global corporate data privacy program and compliance standards to comport with legal compliance requirements for Europe, working in close collaboration with divisional and regional counsels.
  • Provide training and education to legal staff, management and employees relating to data privacy and protection, including key legal issues, laws and regulations, corporate policies and other relevant matters. Support the development and delivery of relevant privacy awareness and training initiatives build privacy awareness into HARMAN’s corporate culture.
  • Understand business issues, anticipate and assess legal risks, and work to develop strategies to reduce potential risks in collaboration with other legal and compliance staff, CIO and other relevant business functions.
  • Act as HARMAN’s Privacy SME, proactively working with internal clients to help them understand the company’s privacy obligations and to identify and mitigate key privacy risks associated with the collection and handling of employee and customer personal data.

 

Basic Qualifications:

  • Law degree from a reputable university.
  • Licensed to practice law in the European Union.
  • Minimum of 7 years of relevant privacy, 10-12 years of product counseling, and transactional experience in addition to privacy (a mix of in-house and law firm experience strongly preferred).
  • Have the ability to translate knowledge and expertise across the company and in conversations with our customers.
  • Ability to work independently and take ownership of projects.
  • Possess excellent legal judgment and the ability to be both pragmatic/business-oriented in order to deliver relevant and actionable guidance to the business.
  • Excel when working collaboratively, and have a record of developing strong working relationships with a diverse client base.
  • Be comfortable in a fast-paced environment and successfully manage many projects simultaneously.

Eligibility Requirements:

  • Willingness to travel 10%.
